Terms & Conditions

Last updated: 25 October 2026

These Terms & Conditions apply when you use mowlai.agency, request a free audit, or buy services from Mowlai Agency. Please read them before you start work with us. If you have any questions, ask us first. We would rather explain something now than have a misunderstanding later.

1. About us

Mowlai Agency is a digital marketing agency for hospitality venues, operated by Mowlai Youness and working remotely from Thailand. In these terms, “we”, “us” and “our” mean Mowlai Agency, and “you” means the business or person using our website or buying our services.

2. Our services

We provide websites, Google visibility and local SEO, social media management, branding, and Google and Meta advertising management for restaurants, cafés, bars, nightclubs, beach clubs, hotels and other hospitality businesses. The current services and prices are published on our website.

3. How we agree the work

Before we start paid work, we agree a written brief with you. The brief sets out what we will deliver, what we need from you, and the price. It can be agreed by email or WhatsApp. If anything in the brief conflicts with these terms, the brief applies for that project.

Work that is not in the brief, such as extra pages, new features or extra content, is outside the agreed scope. We will tell you before doing it and quote it separately. We will not charge you for extra work you did not approve.

4. Prices and payment

  • Prices are as published on our website or in your written brief, in the currency shown.
  • We send invoices by email. Unless your brief says otherwise, invoices are due within 7 days.
  • Monthly services are billed in advance for each month of service.
  • Bank fees, international transfer fees and currency conversion charges on your side are paid by you.
  • Third-party costs are not included unless your brief says so. These include advertising spend, domain names, hosting, premium themes or plugins, booking or ordering systems, stock images and paid software.
  • If an invoice stays unpaid, we may pause the work until it is paid. We will tell you before we do this.

5. Websites: you see it before you pay

For our website service, we build your website first and you pay after you have reviewed it.

  • We build the website to the written brief we agreed with you.
  • You review the finished website. Small corrections that are within the brief are included.
  • If the website meets the brief, you approve it, pay the invoice, and we launch it.
  • If the website does not meet the brief and we cannot correct it, you may cancel and owe us nothing.
  • This is not a promise of unlimited revisions. The website is measured against the brief you approved, not against new requests made after the build.
  • Until the website is paid for in full, the design, files and content we created remain ours. You may not copy or publish them without paying. If you cancel before payment, we will not publish the website and we will not use your logo, photos or venue details for anything else.

The website price is a one-time payment. Ongoing maintenance, such as updates, security, backups and content changes, is a separate optional monthly service.

6. Social media: 14-day free trial

Social media management starts with a free 14-day trial on your real accounts. We do not ask for card details to start. At the end of the trial you decide whether to continue on a paid monthly plan. If you do not continue, you owe nothing, and any posts already published during the trial stay on your accounts.

7. Monthly services and cancellation

  • On a month-to-month plan, you can cancel at any time by email or WhatsApp. The cancellation takes effect at the end of the month you have already paid for, and we do not refund part months.
  • If you choose a longer commitment in exchange for a lower monthly price, you agree to pay for the full term set out in your brief.
  • We may end a service with 30 days’ written notice. If we do, we will finish or hand over the work in progress and refund any amount you have paid for a period we will not cover.

8. Advertising

Advertising budgets are paid by you directly to Google, Meta or the relevant platform, through ad accounts in your business name. Our management fee does not include ad spend, and we do not hold your advertising budget. Platforms decide whether ads are approved and how they are delivered, and their decisions are outside our control.

9. What we need from you

To do good work on time, we rely on you to:

  • give us accurate information about your venue, menus, prices, opening hours and offers
  • supply photos, logos, text and other material that you own or have permission to use
  • give us the account access we need, and reply to approval requests
  • check content before or after it is published and tell us quickly about any error
  • make sure your promotions, events, prices and alcohol advertising comply with the law, your liquor licence and relevant industry codes, such as the ABAC Responsible Alcohol Marketing Code

You are responsible for the material you give us. If you give us material that infringes someone else’s rights, you are responsible for any claim that results.

10. Timing

We agree a working schedule with you in the brief. Timing depends on receiving your material, access and approvals, and on third-party platforms. If something outside our control causes a delay, we will tell you and agree a new schedule.

11. You own your assets

Once you have paid for the work in full:

  • your website, its content and the design files we created for you belong to you
  • your logo, brand guidelines and branding files belong to you
  • the posts, graphics, videos and written content we create for you belong to you

Your domain name, hosting, Google Business Profile, social media accounts, analytics and ad accounts should be registered in your business name or transferred to you. If we set something up for you, we will hand over full ownership when you ask, at no extra cost.

We keep ownership of our general methods, know-how, templates and tools, which we may use for other clients without using your content or brand. Themes, plugins, fonts, stock images and software made by third parties are covered by their own licences.

12. Showing your work in our portfolio

We will only show your venue’s name, website or results in our portfolio, website or social media with your permission. You can withdraw that permission at any time, and we will remove it within a reasonable time.

13. No guarantee of results

We do not promise a specific number of guests, bookings, followers, rankings or sales. Results depend on many things outside our control, including your venue, your offer, your competitors, seasonality and the decisions of Google, Meta and other platforms. What we commit to is the agreed work: the deliverables, the schedule and honest monthly reporting.

14. Third-party platforms

Our work relies on platforms such as Google, Meta, Instagram, TikTok, WordPress, hosting providers and booking systems. We are not responsible for their outages, policy changes, algorithm changes, account restrictions or suspensions. If a platform issue affects your account, we will help you resolve it as part of the service you have with us.

15. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

16. Limit of our liability

To the extent the law allows:

  • our total liability to you for any claim relating to our services is limited to the fees you paid us in the 3 months before the claim arose
  • we are not liable for indirect losses, including loss of profit, revenue, bookings or reputation
  • we are not liable for losses caused by third-party platforms, by material you supplied, or by changes you or others made to the work after we delivered it

17. Confidentiality

We keep your business information, login details and figures confidential and use them only to deliver your services. We ask you to do the same with our pricing proposals and working documents that are not public. Personal information is handled under our Privacy Policy.

18. When work ends

When our work together ends, for any reason, you pay for the work completed up to that date, and we will hand over your files and the access to your accounts, and remove our own access.

19. Free audits and website content

Our free online audits, blog articles and other website content are general information to help you understand your options. They are not legal, financial or tax advice. A free audit does not create any obligation to buy from us.

You may not copy our website content, misuse our forms or try to interfere with how our website works.

20. Privacy

Our Privacy Policy explains how we handle personal information. You can read it at mowlai.agency/privacy-policy/.

21. Governing law

For clients in Australia, these terms are governed by the laws of the Australian state or territory where your venue is located. For clients outside Australia, they are governed by the laws of the place where your venue is located, unless your brief says otherwise. We will always try to resolve any disagreement directly and in good faith before either of us takes formal action.

22. Changes to these terms

We may update these terms from time to time. The version that applies to your project is the one on this page on the date your brief was agreed. If we change terms that affect an ongoing monthly service, we will tell you at least 30 days before the change takes effect.
